Terms and Conditions for Guest renting a Villa
All bookings accepted are subject to these terms and conditions
Definitions.
Agents; Orlando Executive Villas, Executive Villas Florida.com Inc, and or their agents
Guest; Lead Guest, all Party members named on the booking form and any visitors to the Villa during the Guest's stay in the Villa.
Villa; As defined on the booking form
The submission of the booking form and/or payment of a deposit confirms acceptance of the terms and conditions set out
and shall be binding on all members of the party. No parties of guests where all guests are under the age of 21 will be
accepted. No pets or animals are allowed at any time. For the comfort of guests, we have a strict non-smoking policy. To
ensure comfort, security and peace of mind, the villa is registered with the State authorities and in full compliance with all
relevant legislation.
- Rental and booking procedure.
1.1 In the event of a booking being made direct with the company, other than electronically the booking will be considered as
provisional, until receipt of payment and the booking form. Receipt of the said payment must be within seven days of the provisional
booking. The booking will then become a confirmed booking.
1.2 The Villa lead Guest, will be notified in writing by email
1.3 Payment of the deposit by the Guest constitutes an acceptance of all of the terms and conditions by the Guest
and all members of his party.
1.4 The villa is available from 4pm, local time, on the day of arrival. Departure must be by 10am on the morning of
departure. Late check outs on the day of departure may be available, for an additional fee and then only as agreed in
writing by us.
1.5 Brochure/ Web site Descriptions. All brochure and web site descriptions are made in good faith, as provided by the villa owner and or management company. We take reasonable care ensure their accuracy, however, no liability will be accepted in the event of any error, and no refunds will be provided. In the event any item including but not limited to, TV, game consoles have been broken, stolen and not replaced by the home owner, there are no refunds.
1.6. All homes are “self service” The home will be cleaned prior to your arrival and after your departure. Guests will need to provide their own supplies, included but not limited to paper products, detergents, groceries. Linens towels and cookware are provided by the home owner.
- Payment Terms
2.1 Deposit Payment: A non-refundable deposit of 20% of the total price is required to be paid at the time of reservation.
Upon receipt of this deposit and your completed and signed booking form with the details of the party you will be sent a confirmation
of the booking by email. Your booking is provisional and not confirmed until we receive your deposit and completed booking form,
and you receive this email! For short stays, Executive Villas may require at their sole discretion, a full non refundable payment for
the entire booking.
2.2 Balance Payment: Payment of the balance of the booking fee is due no later than 8 weeks prior to your arrival date.
In the event that any booking is made within 8 weeks of the commencement date of the rental period, then payment in full
shall be due and made in full at the time of booking. Upon our receipt of your balance payment, a confirmation will be sent to you.
Failure to make payment of balances in full by the due date may be treated as a 'Cancellation by the Guest' and result in the loss of
the booking and deposit.
- Cancellation, Charges and Refunds.
3.1 Cancellation by Guests. In the event of your party needing to cancel, the following conditions will apply. Up to 8
weeks in advance of arrival, guest will forfeit any and all booking deposit(s) paid. Cancellation by guests between 8 weeks and the arrival date will forfeit 100% of the total charge.
3.2 Cancellation by us. In the unlikely event that circumstances necessitate cancellation of the booking we may refund any monies paid by the party (without interest, compensation or consequential loss of any kind) or, at our sole discretion we will seek to relocate your booking to a villa of a similar or superior standard via the management company.
3.3 Any request by the Guest must be made in writing and will be subject to cancellation charges, including a 5% fee for any reservations made by credit card.
3.4 Refunds will not be made for services included in the rental price that are unused
- Web Site and/or Brochure and/or marketing descriptions.
4.1 All brochure and web site descriptions are made in good faith and every care is taken to ensure their accuracy, however, no liability will be accepted in the event of any error.
- Arrival and Departure and Access codes.
5.1 You will receive full details of the villa, along with directions and door/gate codes 1 week of ahead of your arrival
date.
5.2 The contact information of the local management company will be available in the villa. You should contact the management company with any questions or issues during your stay.
5.3 The Villa will be available to the Guest after 4pm on the day of arrival unless otherwise agreed with us in writing.
5.4 The Villa must be vacated by the Guests no later than 10am on the day of departure unless otherwise agreed by us
writing. Any unauthorized late departures may result in a charge of the equivalent of one day of the rental price paid.
- Insurance.
6.1 The Owner has insured the Villa and the Owners contents and inventory, but does not cover loss of the Guest's property. Claims for loss of property and medical costs will not be made on the Owner's insurance.
6.2 The Owner strongly recommends that the Guest takes out travel, vacation medical insurance and any other insurance to cover unforeseen circumstances, including but not limited to medical, pandemic, airline cancelation, which may necessitate the cancellation of the Guests booking and loss during the Guest's stay at the Villa. For the avoidance of doubt there are no refunds for cancelations for any reason and the guest should secure their own insurance to cover any cancelation risks, known or unknown.
- Amendments to Booking.
7.1 Requests by the Guest to amend a confirmed booking may or may not be accepted at the Owner's sole discretion.
7.2 Amendments must be confirmed in writing prior to the arrival date and any difference in price be paid on the balance due date or in full if the amendment is s made within 8 weeks of arrival at the villa.
- Complaints.
8.1 In the unlikely event of a problem arising during your stay in the villa, you should contact the local management company immediately and they will seek to resolve the matter within a reasonable period of time.
8.2 Complaints will not be accepted after the end of Guest's stay at the Villa.
- Owner's / Orlando Executive Villas / Management Company Access.
The Designated Management Company reserves the right to access the Villa at any time during the Guest's occupancy. This will include, but is not limited to, random checks on the condition of the Villa during the Guest's occupancy,
emergency access to the Villa and access to the Villa as the result of a complaint by the Guest or any third party. This access includes This includes, but is not limited to, such workers as maintenance crew, gardeners, etc.
- DAMAGE PROTECTION PLAN.
We understand while you are on vacation that it is your time to enjoy your family and relax. Don’t let small incidental
damages ruin your vacation. We know that small spills on the carpet and marks on the wall will happen. Although there
are accidents, there is still a cost to correct the unintentional damage. This is why your booking includes the Damage
Protection Plan. For a flat, non-refundable $99.00 fee, you will be covered for all small damages up to $300.00.
This will cover you for stains on the carpet, marks on the wall, broken dishes, stained or damaged towels, and other small
items. The Damage Protection Plan does not cover negligence or gross negligence on the part of the renter or guests nor
does it cover intentional damages to the property. It also does not cover theft. If small damage does occur, the credit
card on the reservation will not be charged. The only time the card would be charged is if the damage is negligent and
gross intentional damages, or exceeds $300.00. Please note: Guests must also report any damages upon arrival. If
damages occur, these guests must also contact the management company and report the damages. Failure to do so will
void the protection plan.
- Loss & Damage.
11.1 The Guest or any member of his party or any visitors to the property must not alter any settings on any pool valves, pool heating or irrigation systems controllers. Unauthorized alterations may cause operating problems and any
rectification costs will be reimbursed by the Guest.
11.2 Any loss or damage not covered in THE DAMAGE PROTECTION PLAN will be charged to the lead guests credit card or reimbursed by the lead guest within 7 days of departure from the villa.
11.3 Any misuse of the Villa's systems resulting in costs being incurred will be reimbursed by the lead Guest. This includes, but not limited to:
11.3a Air conditioning, which must not be set below 72F as freezing of the unit can occur. A minimum call out charge is currently $85 plus the cost of any repairs required
11.3b Pool valve equipment must not be tampered with. If the pool is drained or the pumps / filters stop working the Guest will be responsible for the full cost of call out and repairs.
11.3c Loss of keys - the Lead Guest will be charged for locksmith call-out, and the cost of replacement locks, keys or
pass cards
11.3d WC blockages - the Lead Guest will be charged for failure to comply with the Management Company instructions or posted signs regarding the WC resulting in a plumber call-out
- POOL HEAT and POOL HEAT REFUNDS.
12.1 Pool heat will automatically shut off if the temperature drops below 50 degrees Fahrenheit. The Property
Management cannot override this precaution as it is a security measure to prevent breaking the pool pump. Refunds will not be given if this occurs.
12.2 Pool heat is set between 83F-89F. The pool heat pump operates approx. 8-10 hours per day.
12.3 If pool heat is not pre-booked and paid for in advance, and is requested the day of arrival or once you are at the
property, there will be a $25 call out fee, in addition to the cost of pool heat. It will take a minimum of 48 hours to heat up, the guest is responsible for the cost of the time to heat up the pool. The onsite team will only turn on the pool heat during regular office hours.
12.4 If pool heat is not working properly, the guest must contact the management company during specified business
hours. If the pool heater is confirmed broken, pool heat refunds will be given will be strictly limited to the cost of the pool heat for the number of days the guest is without this service, and there will be no further refund or compensation for any inconvenience. Guests must notify the management company of any pool heat issues as they occur. Refunds will not be given when pool heat issues are brought to our attention after the stay.
- Use of Swimming Pool.
13.1 Swimming pools and spas can be dangerous and those at the Villa are not to be used by children without
supervision.
13.2 No bubble bath or similar liquids are to be used or added to the swimming pool or spa.
13.3 Glass or bottles are not allowed in the pool area or spa
13.4 Alarms on doors and windows from the house, to the pool, and/or pool safety nets are provided for the safety of the Guest, all members of his party and any visitors to the Villa. These should not, under any circumstances, be disabled as this contravenes Florida State Law requirements
13.5 All swimming pools are used entirely at the guest's own risk. No diving is allowed and children must
be supervised at all times. Glass is not permitted in the pool area at any time. Please use the plastic ware
provided
- Non-Smoking.
14.1 For the comfort of all of our Guests, smoking is not allowed inside the Villa. Should the designated Management Company deem that a Guest has allowed smoking in the Villa any costs incurred in removing evidence of smoking, which includes but is not limited to a minimum $350 cleaning fee will be reimbursed by the Guest.
14.2 Smoking is only allowed on the outside of the home provided that all the doors and windows of the home are shut to prevent smoke from blowing into the home and, if applicable, is done in designated areas of the community and does not violate any of the community’s smoking policies.
- Animals & Pets.
Animals and pets are not allowed in any area of the Villa. Should the designated Management Company deem that a Guest has allowed animals or pets in the Villa any costs incurred in removing evidence of animals or pets will be
reimbursed by the Guest, including but not limited to a minimum $350 cleaning fee.
- Insects & Pests.
The Villa receives periodic regular pest control treatment; however, insects and pests are inevitably present in the Florida climate. The Owner cannot guarantee the total absence of insects or pests and action will only be taken when deemed necessary by the Management Company.
- Accommodation.
17.1 Only the persons named on the booking form, or agreed by us in writing are permitted to stay in the Villa. It is an offence in Florida to exceed the maximum occupancy limit as defined in the rental license. Resort communities require a full list of all guests who may stay in the home, and all drivers who may access the community at any time during the stay. If you do not provide a list of all drivers who may want vehicle access the resort and all guests who will stay in the home in this booking form, and the resort gate house security refuse you entry, then you and all guests accept full responsibility and there will be no refunds or compensation.
17.2 Subletting, sharing or assigning is strictly prohibited.
17.3 An adult must accompany persons under the age of 18.
17.4 Any damage to the Villa found upon arrival of the guest must be reported to the designated Management Company immediately. If not reported, it will be assumed that any damage to the Villa found during the departure inspection has been inflicted by the Guest.
17.5 The lead guest on the reservation must be over 25 years old and must be staying in the home for the entire stay. If
the lead guest is not staying in the home, this makes the reservation void and the group must leave the home without a
refund for the rental.
- Villa Guests / Residents.
18.1 The Owner / Management Company and Orlando Executive Villas reserves the right to decline or accept or retain any person as a client or guest whose conduct is deemed to be disruptive or effects the enjoyment of other
holidaymakers at any time during their stay. The Owner / Management Company / Executive Villas Florida will be under no obligation or liability to accept costs incurred or responsibility for any such person.
18.2 The Guest will be responsible for behaving in a responsible manner and in accordance with local regulations. The Owner / Management Company / Executive Villas Florida, does not accept any responsibility for the termination of travel or holiday arrangements due to the Guest causing distress annoyance, damage or danger to others.
- PARKING & VEHICLES.
19.1 Guests must park in designated parking areas or in the driveway. Roadside parking is prohibited. Any fees incurred from tickets or towing expenses are the sole responsibility of the guests.
19.2 No over size vehicles will be permitted entry into any gated resort community, including but not limited to RVs, trailers and buses.
19.3 From time to time, Resorts may have a maximum vehicle entry policy for each home, and the Resort will not allow entry for more vehicles than this limit for each home, regardless of the number of guests. The Guest accepts that we have no control over this and you hold us harmless.
- ZERO TOLERANCE POLICY: Guest will be immediately asked to vacate the property, without refund or reimbursement of any kind, if any of the following rules are broken:
20a Maximum Occupancy. Please make sure you do not have more guests at the property than the property
accommodates. At no time can there be more guests at the home than the maximum occupancy. This includes friends and family visiting.
20b Only those guests listed by the lead guest when submitting this booking form are permitted to stay in the property. If at any time, the home owner or management company or Orlando Executive Villas become aware that there are more guests in the home than declared on this booking form by the lead guest, then all guests will be asked to leave the home for the remainder of the booking, without refund or recompense or any reimbursement, and all guests will need to find alternate accommodation at their own cost.
20c Unless paperwork is provided for a service dog before arrival, we have a zero-pet policy.
20d We have a non-smoking policy. No smoking is allowed in the home.
20e Underage Drinking or use of illegal substances. Underage Drinking is not allowed and will not be tolerated. If this
occurs, we will notify the local authorities and guests will be subject to all local county and/or state laws pertaining to this
violation.
20f Noise Disturbances that are affects guests in other homes around the house you are staying in
20g The lead guest on the reservation must be staying in the home for the entire stay.
20f Noise Disturbance should be avoided and guests need to be respectful of their neighbors. Do not disturb other guests while they are on vacation and please keep noise levels down, especially in the early mornings and late evenings.
- NEIGHBORHOOD FACILITIES.
Some of our properties have facilities that are controlled by the neighborhood home owner’s association. From time to
time there may be maintenance or repairs that are needed. This could cause the closure of these facilities for short
periods. Some examples are but not limited to: Community swimming pools, clubhouse, pool heaters, and community
Jacuzzi’s. If there is a closure of these facilities during your stay, then we will not be held liable or responsible for
customer refunds.
- Services requested and provided by the Management Company after your arrival.
Any issues arising from the use of extra services provided by the designated Management Company should be dealt with directly with the designated Management Company. Orlando Executive Villas accepts no responsibility for any
independent arrangement whatsoever between the Guest and the designated Management Company or any between the guest and any other 3rd party.
- 23.
Neither Orlando Executive Villas nor its agents are responsible for any new or continuing construction work in the vicinity of any of the homes. There are no refunds for any reason related to construction, including but not limited to, construction worker, vehicle, site traffic or construction noise, nor any related construction dust, dirt or debris.
- Other terms and conditions.
Florida has a sub-tropical climate and care must be taken with food that is left uncovered. Uncovered food can attract
insects very quickly. Any added costs for pest control services incurred for lack of care may be passed to you. Trash must
be placed in sealed garbage bags in the bins provided in the trash compound adjacent to the villa. Trash must not be left
in the garage.
- Force Majeure.
We, and our agents accept no responsibility or liability for any loss or damage or alterations to the terms of this booking caused by events beyond our control including, but not restricted to, war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation of schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.
- Safety & Security.
Due to state fire regulations, all individuals occupying the villa must be identified on the booking form. All swimming pools are used entirely at the guest's own risk. No diving is allowed and children must be supervised at all times. Glass is not permitted in the pool area at any time. Please use the plastic ware provided. All guests are responsible for locking the doors to the extent of locks available at the property before leaving at any time during their stay.
- LIABILITY:
To the maximum extent permitted by applicable law, We, (Orlando Executive Villas) the
villa owners, all management companies, including but not limited to Executive Villas Florida and our agents do not accept
any responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects, however caused while
you are in the home, swimming pool, surrounding areas or resort. No responsibility is accepted for any death, illness,
loss or damage to property and/or motor vehicles. There is not a life guard on duty at any of the
properties. All guests enter at their own risk. Children under the age of 18 should be supervised while
swimming at all times. If you are pregnant, or have a heart condition, please consult your doctor before
swimming or getting in a jacuzzi / hot tub. Any persons who has been drinking alcohol, on drugs or
medication, anyone who has the flu, or any type of infection, should not enter the water.
The Owner, Executive Villas Florida, acting as agent or its designated Management Company, as applicable, accepts no responsibility for, and shall not be liable in respect of any loss, damages, alteration, delay or changes arising from circumstances outside our control. These include (but are not limited to) war (or threat of war), acts of terrorism, fire, adverse weather conditions, government actions, closure, congestion of airports, cancellation or changes of flight schedules, pandemics, theft from the Villa premises (both interior and exterior including garage and pool & spa areas), ongoing construction or alteration work to any house which may affect the Guest and his party and complaints about the Villa which have not been reported to the Management Company.
The undersigned and all guests hereby agree and do hereby release from liability Orlando Executive Villas
and to indemnify and hold harmless Orlando Executive Villas, and any of its officers, employees or agents
representing or related to this booking and villa rental. This release is for any and all liability for personal
injuries (including death) and property losses or damage occasioned by, or in connection with this booking
and/or villa rental.
All guests understand, acknowledge and agree that Orlando Executive Villas acts solely as the payment process facilitator,
or booking facilitator between the Guest and the home Management Company and/or Owner. In the event of any dispute,
loss or claim, all guests agree that all claims for any event, shall be directly between (a) the guests and (b) the villa
management company and/or the villa owner and, shall not involve Orlando Executive Villas, our staff or agents in any capacity.
You and all guests agree that regardless of any statute or law to the contrary, any claim or cause of action arising out
of or related to use of our website, the villa or this booking, and/ or this Agreement or any services provided must be filed
within 14 (fourteen) days after such claim or cause of action arose or be forever barred.
For the avoidance of doubt, the undersigned and all guests shall hold Orlando Executive Villas, its officers, agents
and employees harmless.
- Governing Law
The entire agreement and all disputes governed by the laws of the State of Florida.
